2. Scope
These Terms of Use govern only the browsing and use of the public Website, including any language versions and pages dedicated to the project, solutions, company activities and contact requests.
They do not govern the activation of, access to or contractual use of the DigiTracker and DigiReceiver software applications. Access to SaaS services and relationships with business customers are governed by the respective commercial agreements, terms of service and privacy documents. Browsing the Website does not, in itself, conclude a contract with Saetta.
3. Purpose of the Website and nature of the information
The Website presents DigiHORECA and its technological solutions for the Ho.Re.Ca. supply chain, describing their features, intended users, general methods of use, developments and opportunities to contact the team.
Product information, descriptions and representations serve illustrative and promotional purposes. The availability of features, financial terms, service levels and any commitments by Saetta are defined solely in the agreements applicable to each customer. Indicating features under study, development or testing does not constitute a commitment to release them by a specific date.
Where expressly identified as demonstrations, the interfaces, data and examples shown on the Website illustrate possible use cases and do not necessarily represent the production environment or results achievable by every customer.
4. Browsing and proper use
You may browse the Website and use the accessible information for lawful purposes consistent with its informative nature. Uses, quotations and reproductions permitted by law remain allowed.
Activities intended to compromise the security, availability or integrity of the Website, introduce malicious code, circumvent protective measures or unlawfully collect personal data or protected content are not permitted. Any automated use must comply with applicable law, legitimate technical measures and content holders' rights.
5. Requests for information and contact
The “Request a call” form and contact addresses allow you to send Saetta requests for information, proposals or requests for product presentations. Submitting a form does not automatically create a contractual relationship, a binding booking for a service or a right to activate a service.
Requesters are asked to provide accurate and relevant data and to avoid entering confidential information, special categories of personal data or documents unnecessary for the request in the free-text field. The processing of the data provided is described in the Website's Privacy Policy.
6. Intellectual property, content and distinctive signs
Text, layouts, graphics, images, photographs, videos, illustrations, documentation, software and other materials on the Website are protected by copyright and industrial property law where the relevant conditions are met. These materials belong to Saetta or their respective holders and are used under the applicable rights or permissions.
The names DigiHORECA, DigiTracker and DigiReceiver and the other distinctive signs on the Website identify the respective projects, services and products. Browsing the Website does not grant visitors licences or rights to use such signs commercially. The protections provided by applicable law for trade names, distinctive signs and other protectable content remain in force, within the limits of the rights that actually exist.
Except for uses permitted by law, substantial or systematic reproduction, commercial distribution, modification and use of content in a way that suggests non-existent authorisation, sponsorship or a relationship with Saetta are prohibited without the prior consent of the relevant rights holder.
7. Illustrative data, results, images and statements
Any examples of dashboards, analyses, automation, error reduction, time savings or process improvements illustrate product features and use cases. Specific economic or operational results depend on the context, data quality, methods of use and other concrete circumstances.
Unless expressly committed to in a contract, these examples do not guarantee individual results or replace operational, accounting or professional checks that are the responsibility of the competent parties. Saetta undertakes to ensure the accuracy of published information and to correct material inaccuracies of which it becomes aware.
8. External links and third-party content
The Website may contain links to third-party websites, services, social networks or resources and references to partners, customers or other organisations. Links serve information or navigation purposes and, unless expressly stated otherwise, do not imply approval of all the external party's content or services.
Third-party websites and services are subject to their own terms of use and privacy notices. Saetta does not continuously monitor these resources and is not responsible for their content or conduct beyond what is required by mandatory legal provisions.
9. Availability, updates and security
Saetta may maintain, update and modify the Website and its content, including without notice where necessary for technical or security reasons. An absolute absence of interruptions, errors or incompatibility with all devices and software used by visitors is not guaranteed.
Visitors are encouraged to use up-to-date tools and devices and to report any problems through the company contact details. All liabilities and protections that cannot be excluded by law remain unaffected.
10. Privacy and cookies
The processing of personal data relating to visitors, people using the contact form and contact persons writing to Saetta is described in the Website's Privacy Policy, available at https://www.digihoreca.it/en/legal/privacy/.
The use of cookies and similar technologies, including any measurement and advertising systems, is explained in the Cookie Policy, available at https://www.digihoreca.it/en/legal/cookie/. Where required, preferences are managed through the consent system implemented on the Website.
11. Changes to these terms
Saetta may update these Terms of Use to reflect changes to the Website, company information or applicable law. The published version states the date of the last update. Changes do not retroactively alter contracts already concluded with customers, which are governed by their respective documentation.
12. Applicable law and contact details
To the extent relevant to browsing the Website, Italian law applies, without prejudice to any applicable mandatory rules. Disputes are subject to the courts determined in accordance with the law, without prejudice to any mandatory jurisdiction protecting users.
